These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Services") provided by Yugo Inc. ("Yugo Inc.", "we", "us", or "our"). Yugo Inc. is the company that operates the YugoGPS, YugoDMS, YugoPay, and YugoVIN products. By accessing or using the Services, you agree to be bound by these Terms.
1. Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for your account, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. You agree not to misuse the Services, interfere with their normal operation, or attempt to access them through means other than the interfaces we provide.
2. Accounts and Eligibility
Some Services require an account or a separate written agreement. You represent that the information you provide is accurate and that you have the authority to enter into these Terms on behalf of any organization you represent. We may suspend or terminate accounts that violate these Terms.
3. Customer Data
As between you and Yugo Inc., you retain ownership of the data you submit to the Services. You grant us the limited rights necessary to host, process, and transmit that data solely to provide and improve the Services. Our handling of personal information is described in our Privacy Policy.
4. Product-Specific Terms
Individual products may be subject to additional terms, order forms, or service agreements. Where those terms conflict with these Terms, the product-specific terms control for that product. Where a product enables vehicle-related actions or payment processing, you are responsible for using those features lawfully and in accordance with your agreements with your own customers.
5. Intellectual Property
The Services, including their software, design, and content, are owned by Yugo Inc. or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or branding except as needed to use the Services as intended.
6. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
7. Limitation of Liability
To the maximum extent permitted by law, Yugo Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Services.
8. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. The state and federal courts located in the State of Illinois will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
